Tunnel.com, LLC ("Tunnel.com", "Tunnel", "we", "us" or "our" or "the Site") is located at 142 E 39th St., New York, NY 10016. At Tunnel.com, our users' privacy is extremely important to us, and we have designed this privacy policy to show our commitment to protecting your personal information. This Privacy Policy is intended to explain to you, the user, the information we collect, how that information may be used, with whom it may be shared, and your choices about the use and disclosure of your information.

Definition of terms.
“You” and “your”- refer to you, as a user of the service. A “user” is anyone who uses the service. This includes but is not limited to: browsing, accessing, searching etc.
“We”, “us” and “our” refer to Tunnel.com
“Content” refers to all data of all forms (e.g. photo, audio, video, locations, text, survey data etc.)
“Your Content” refers to all the data that you submit in connection with the service; that is information you submit to, through, or in connection with the Tunnel.com. This includes but is not limited to reviews, surveys, personal data, invitations, profile data, photo, etc.
“User Content”, refers to all the data that users submit in connection with the service; that is information users submit to, through, or in connection with the Tunnel.com. This includes but is not limited to reviews, surveys, personal data, invitations, profile data, photo, etc.
“Tunnel Content” refers to all the data that we create in connection with the service.

Why we collect information about users, and what it’s used for.
When you use Tunnel, create an account, or browse the Site, we collect information such as your name and e-mail address, physical address, and all other information for identification purposes, relevant advertisements, demographic information as well as other purposes listed below. When you provide personal information to Tunnel, the information may be sent to servers located in the United States and other countries around the world.
We may use information we collect about you to: deliver the products and services that you have requested; manage your accounts and provide you with customer support; perform research and analysis about your use of, or interest in, our products, services, or content, or products, services or content offered by others; communicate with you by e-mail, postal mail, telephone and/or mobile devices or any media about products or services that may be of interest to you either from us or third parties; develop and display content and advertising tailored to your interests on Tunnel and other sites; verify your eligibility and if applicable deliver prizes in connection with contests and sweepstakes; enforce our terms and conditions; manage our business and perform functions and otherwise described to you at the time of collection. At our option we may delete information from our records permanently.
How we obtain user information
Provided by you. We may collect and store any personal information you enter on Tunnel, or provide to us in some other manner, including through surveys conducted on Tunnel. This includes identifying information, such as your name, address, telephone number, and email address, and if you transacted business with us, financial information such as your payment method (valid credit card number, type, expiration date or other financial information.) We may also request information about your activities, your age and gender, and other demographic information as well as public information such as user ratings and reviews, saved restaurant and business listings, and other information you view on Tunnel.
Provided by you about others. We may also collect and store personal information about other people, that you provide to us. If you send information through or by the use of Tunnel to other recipients (friends, relatives, business associates, etc.), messages, information that may interest them, or messages, we may store that information, and the personal information of each such recipient

Job Applications. When personal information is submitted to Tunnel through any of our websites or third party job sites to apply for a position with our company, the information will be retained and used for the sole purpose of considering your application, and the duration of time that process may take, and may be retained longer for consideration of future positions. At our option we may delete information from our records permanently.

Information that is automatically collected
General Browsing Information. We automatically collect information from your browser when you visit Tunnel. This information includes you IP address, your browser type and language, access times, the content of any undeleted cookies that your browser previously accepted from us (see “Cookies” below), and the referring website address. When you visit Tunnel, we may assign you computer one or more cookies, to facilitate access to Tunnel and to personalize your online experience. Through the use of a cookie, we also may automatically collect information about your online activity on Tunnel, such as the web pages you visit, the links you click, and the searches you conduct on Tunnel. Most browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies. If you choose to decline cookies, please note that you may not be able to sign in or use some of the interactive features offered on Tunnel
Cookies. Generally, cookies are set to automatically collect data. The quantity and duration of information stored on your computer your browser’s settings. You may delete or decline cookies by changing your browser settings (click “help” in the toolbar of most browsers for instructions.) If you do so, some of the features and services of Tunnel may not function properly
Third-party content. Third party content, authorized by us, may use tracking technologies, such as cookies, to collect information about users who view or interact with their advertisements. (See below for more information)
Web Beacons. Web beacons (also known as clear gifs, pixel tags or web bugs) are tiny graphics with a unique identifier, similar in function to cookies, used to track the online movements of web users or to access cookies. They may be used to deliver or communicate with cookies, to count users who have visited certain pages and to understand usage patterns. We also may receive an anonymous identification number if you come to Tunnel from an online advertisement displayed on a third-party website.
Activity and log data. We automatically store information related to your use of the Site, such as the pages you view on the Site, your browser type, IP address, the phone numbers and names of businesses that you call through the Site, requested URL, browser language, referring URL, and the date and time of your visit. We use this type of information to administer the Site and provide the highest possible level of service to you. We also use this information in the aggregate to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of the Site.
All Other Technologies. We may use standard Internet Technology, including and similar to Web Beacons, in our effort to track the use of Tunnel; these technologies may collect data about your usage as well. These technologies may also appear in promotional messages or general e-mail messages, as well as newsletters. This data is used to determine whether messages have been open and acted upon. The information we obtain in this manner enables us to customize the services we offer Tunnel visitors to deliver targeted advertisements and to measure the overall effectiveness of our online advertising, content, programming or other activities.
Information collected by Third Parties, or sources other than Tunnel.com
Social media. In general, we collect personal information that you voluntarily submit to us through social media sites (such as Facebook, Twitter, etc.), such as information that you submit in the process of creating or editing your account and user profile or your photos, videos or other personally identifiable content you upload and choose to share with us via social media sites. We may also import and collect your Personal Information from other social networking sites and websites with your permission (i.e., by providing your personal ID and password for those sites) and associate such information with you.
Third-parties. We may allow third-parties, including our authorized service providers, advertising companies, and as networks, to display advertisements or provide application companies, and ad networks, to display advertisements or provide applications and services on Tunnel. These companies may use similar technologies, such as cookies or web beacons to collect information about users who view or interact with their advertisements or use their applications and services. Tunnel.com does not provide any personal information to these third parties, but they may collect information about where you, or others who are using your computer, saw and/or clicked on the advertisements they deliver, and possibly associate this information with your subsequent visits to the advertised websites.
They may also combine this information with personal information they collect from you. The collection and use of that information is subject to the third-parties’ Privacy Policy. This information allows them to deliver targeted advertisements and gauge their effectiveness. Some of these third-party advertising companies may be advertising networks that are members of the Networking Advertising Initiative, which offers a single location to opt out of ad targeting from member companies.
Third party websites. On Tunnel, there are various places where you may click on a link to access other websites that do not operate under this Privacy Policy. If you are taken to a website that not controlled by Tunnel, these third-party websites may independently collect information, including personal information about your activities on those websites, and use it based on THEIR Privacy Policy. We recommend that you consult the privacy statements of all third-party websites you visit by clicking on the “privacy” link typically located at the bottom of the webpage you are visiting.
No Rights of Third Parties: This Privacy Policy does not create rights enforceable by third parties or require disclosures of any personal information relating to users of Tunnel.com.
Who We Share Your Information With and how it’s used
If Tunnel shares your information in any way other than those described below, we will inform you and give you and opportunity to opt-out of having your personal information shared. We may share personal information with:
Authorized service providers. We have certain providers that perform services on our behalf, when authorized. We may share your all or any personal information these providers to enable them to perform their functions. These services may include but are not limited to: marketing, processing credit card payments and delivering packages. They are not permitted to share or use such information for any other reason than the designated purpose.
Business partners. We may share your personal information with business partners in the situations indicated below:
Purchases: When using Tunnel, if you choose to participate in a particular merchant’s offer or program, you consent us to provide your e-mail address and other information to that merchant. When making purchases, reservations or engaging in promotions offered through Tunnel or our services, we may share your personal information with the businesses with which we partner to offer you those products, services, promotions, contests and/or sweepstakes.
Promotions. If and when engaging in promotions, contests, and other services offered through Tunnel, or affiliated services, we may share your information with the sponsor or business partner issuing the promotion.
Reservations. By making reservations on or through Tunnel.com for services provided by third parties, including government entities, you consent us to provide personal information and reservation information to these reservation partners. Sharing this information with our reservation partners allows them to contact you using the e-mail address or other contact information you provided.
Communication. We may provide areas on our website where you can post information (i.e. blogs, chat rooms, bulletin boards etc.) about yourself and others, and communicate with others, as well as post reviews of businesses, products, establishments, contractors, and the like, or upload content (e.g. pictures, videos, audio files, etc.). Such postings are governed by our Terms of Use. These postings may also appear on other websites or when searches are executed on the subject of your posting. Any voluntary disclosure of information on publicly viewable web pages, makes that information public, and can be collected by others, outside of our control. For example, if you post your email address, you may receive unsolicited messages. It is encouraged you exercise discretion and caution with respect to you personal information.
Financial information. We may use financial information or payment method to process payment for any purchases made on Tunnel, to protect against or identify possible fraudulent transactions, and otherwise as needed to manage our business.
Other Situations Where We May Disclose Your Information
In response to a Subpoena. or similar investigative demand, a court order, or a request for cooperation from law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us. When we believe disclosures is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees or others; to comply with applicable law or cooperate with law enforcement; or to enforce Tunnel’s terms and conditions or other Tunnel.com agreements or policies.
Composite data. We may share generally collected and non-personal information we collect under any of the above circumstances. We may also share it with third parties to develop and deliver targeted advertising on our websites and on websites of third parties. We may combine qualitative data (surveys, website statistics, and demographics) and qualitative data (how the website is being used) with additional non-personal information with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis. For example, we may tell our advertisers the number of visitors to Tunnel and the most popular features or services accessed. This information does not contain any personal information and may be used to develop website content and content and advertising. For merchants, we may share your business, name, address, telephone number, email address and name of owner.
Inquiry and Investigation. We reserve the right to investigate abuses on the Site, and enforce and apply our Terms of Service and Statement. User control and choices
Providing information. You can choose not to provide us with certain information, but that may result in you being unable to use certain features on Tunnel, because such information may be required on order for you to have personalized recommendations presented to you; register as a member or user; purchase products or services; participate in a contest, promotion, survey, or sweepstakes ask a question; or initiate other transactions on Tunnel.
Unsubscribe to emails and promotions. At any time you can choose to no longer receive commercial or promotional emails or newsletters from us by logging in with your account information, clicking on the “My Tunnel” link, then clicking on the “My Newsletters” link and selecting those portions of your communication settings you would like to update. You also will be given the opportunity, in any commercial e-mail that we send to you, to opt out of receiving such messages in the future. It may take up to 30 days for us to process an opt-out request. We may send you other types of transactional and relationship e-mail communications, such as service announcements, administrative notices, and surveys, without offering you the opportunity to opt out of receiving them. Certain portions of the site may not give you the option to opt-out, in those instances your acceptance of use of Tunnel gives us permission to send mail, or e-mail. If you choose to not receive any mail, or e-mail, you may discontinue using the service by deleting your account.
Please note that changing information in your account or otherwise opting out of receipt of promotional email communications will only affect future activities or communications from us.
If we have already provided your information to a third party (such as an event provider), before you have changed your preferences or updated your information, you may have to change your preferences directly with that third party.
Accessing Your Information. If you have an online account with us, you have the ability to review and update your personal information online by logging into your account. You can also review and update your personal information by contacting us (see Contact Us below).
Managing Your Information. We provide a number of tools to manage the use of your information on the Site. You may receive weekly newsletter communications from us. However, despite any requests to close your account or your indicated email preferences, we may still need to contact you as required by law or on legal matters, for example to inform you of any updates to our Terms of Service or this Statement.
Security measures and choices. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, searches, or other communications will always remain secure.
Children’s privacy-Tunnel does not knowingly collect personal information from children under the age of 13.
